Derek McNee, a former police officer, has been sentenced to seven years in prison at the High Court in Glasgow after admitting to raping a sleeping woman. According to BBC News, the 43-year-old preyed on his victim at a house in East Dunbartonshire in 2025, filming himself committing the assault on his mobile phone.
McNee was apprehended after police discovered four incriminating videos on his device. Judge David Young KC imposed the sentence and ordered McNee to be monitored for 18 months following his release. The judge told McNee:
As you recognise, there can be no free agreement when someone is incapable to give consent.
The victim provided two impact statements to the court, describing her "misery" at the hands of McNee and detailing how she continues to be affected by his actions. According to The Scottish Sun, one of the recovered videos lasted 35 minutes, during which the woman audibly objected to what was occurring.
How did the assault take place?
The assault occurred after McNee asked the woman whether it would "arouse" her if he "did things" while she was sleeping. The woman agreed to this proposition, and McNee suggested filming the acts. She consented to the recording, though she later asked him to delete the footage after viewing it.
Prosecutor Ruaraidh Ferguson outlined to the court that four videos were recovered from McNee's telephone depicting him performing sexual acts on the woman while she was clearly intoxicated.
At various stages, she is asleep or unconscious. In one video, McNee wore a mask across his eyes while the woman remained "fully unresponsive throughout." According to The Scottish Sun, in the final video, the woman was initially awake and said, "Get raped," before falling asleep.
What was McNee's background?
McNee served as a police officer for seven years before establishing a dog grooming business in Paisley. His criminal history extends beyond the current conviction. In 2021, he was placed under supervision and a curfew after being convicted of terrorising a young woman at Glasgow Sheriff Court, where he was found guilty of engaging in abusive conduct.
During that earlier incident, McNee assaulted the woman, threatened to kill her, and destroyed her designer jacket using tweezers. The victim recalled seeing "the devil in his eyes" during her ordeal.
What other offences did McNee commit?
Beyond the rape conviction, McNee pleaded guilty to harassing another woman between 2021 and 2025 across Glasgow and Paisley. The harassment was severe enough that the victim was forced to change her phone number, but McNee discovered the new number and contacted her almost 30 times within two days.
McNee also admitted to possessing a stun gun, which was discovered during a search of his car in August 2025.
What restrictions has McNee faced?
Judge Young placed McNee on the sex offenders register indefinitely. He was also issued an indefinite ban preventing him from contacting or approaching either of his victims. The 18-month post-release monitoring order will ensure continued oversight of his conduct following his imprisonment.
Tony Graham KC, defending McNee, told the court:
He has accepted his guilt - that is the best thing that can be said in mitigation on his behalf.
