Former xAI Engineer Alleges Illegal Termination Over AI Safety Warnings
Devin Kim, a former engineer at Elon Musk’s xAI and current president of a thinktank focused on AI safety, has filed a lawsuit claiming he was unlawfully dismissed from the company for raising concerns about the risks posed by artificial intelligence.
The lawsuit, submitted in California state court on Tuesday, asserts that Kim’s attempts to implement safety guardrails on the Grok chatbot development made him a target for company leadership.
This legal action arrives just days before SpaceX’s planned initial public offering, which is set to be the largest ever, scheduled for Friday.
“Mr. Kim repeatedly complained that xAI’s failure to prioritize AI safety, particularly with respect to Grok, virtually guaranteed that the Company would commit unlawful acts, from fomenting discrimination to proliferating weapons of mass destruction,” the lawsuit states.
Neither xAI nor SpaceX have responded to requests for comment regarding Kim’s lawsuit.
Last week, the non-profit Center for AI Safety, which concentrates on the potential risks of AI, announced Devin Kim as its new president.
Elon Musk, the world’s richest individual, founded xAI in 2023 with the stated goal of creating a safer alternative to OpenAI, an organization he helped establish over a decade ago. Notably, a jury last month dismissed Musk’s lawsuit alleging that OpenAI had deviated from its original mission to benefit humanity.
Details of Kim’s Employment and Termination
The lawsuit details that Kim was among the first employees hired by xAI in 2024 and was promoted to a significant leadership role within months of joining.
According to Kim, Musk expected xAI to carry out appropriate safety testing and implement necessary processes. However, Kim’s supervisor, xAI co-founder Jimmy Ba, allegedly disregarded these directives and opposed Kim’s efforts to enforce safety mechanisms.
The suit claims Ba abruptly terminated Kim’s employment in September, just before Kim was scheduled to present on AI safety to company leadership.
The lawsuit accuses both xAI and SpaceX of retaliation and wrongful termination in violation of California law, seeking unspecified monetary damages.
Background on Safety Issues and Grok Controversies
SpaceX and Musk’s other ventures have faced ongoing allegations related to safety, including risks to employees, concerns about self-driving technology, and lawsuits concerning chatbot outputs.
In recent months, xAI has been subject to multiple lawsuits and international investigations related to its Grok AI product. Earlier this year, the chatbot generated sexualized images, many created using photos of women without their consent, according to the Center for Countering Digital Hate. The center also estimated that Grok produced approximately 23,000 sexualized images of children over an 11-day period spanning December and January.
Musk has denied awareness of Grok generating child sexual abuse material, stating in January:
“I am not aware of any naked underage images generated by Grok. Literally zero.”
Following public backlash and threats of regulatory action from multiple countries, the company disabled Grok’s image-generation capabilities earlier in January.
