Former Elite Police Officer Charged with Whistleblower's Murder
A former member of an elite police unit, Matipandile Sotheni, 41, has been charged with the murder of whistleblower Marius van der Merwe, who testified at a major police corruption inquiry in South Africa.
Sotheni appeared in court accused of killing Van der Merwe in December last year. He is alleged to have shot Van der Merwe in the presence of his family, a case that sparked national outrage. Sotheni has not made any public comments regarding the charges.

Whistleblower's Testimony and Its Impact
Van der Merwe, who was identified only as "Witness D" during his testimony at the inquiry known as the Madlanga commission, implicated police officials in the torture and murder of a robbery suspect. His testimony revealed significant police corruption at the local level in South Africa and resulted in the suspension of several officers named in his statements.
Background of the Madlanga Commission
The Madlanga commission was established by President Cyril Ramaphosa following allegations from a senior police officer that organised crime groups had infiltrated government structures. This led to the suspension of South Africa's Police Minister Senzo Mchunu, who has denied any connections to criminal gangs. South Africa's parliament is also conducting investigations into these allegations.
Deaths Among Those Implicated
Besides Van der Merwe, three of the 12 individuals implicated in the killing of the robbery suspect have died. Police report that two were shot dead, and one died by suicide.
Details of the Robbery Suspect and Related Accusations
The robbery suspect has been identified as Emmanuel Mbense, who died in April 2022. Van der Merwe testified that he was ordered by local police chief Julius Mkhwanazi to dispose of Mbense's body. Mkhwanazi has since been suspended over these accusations, which he denies. No arrests have been made in connection with this case.
Investigation and Arrests in Van der Merwe's Murder
Sotheni was arrested over the weekend and is one of three suspects identified by police in the murder of Van der Merwe. Police spokesperson Brigadier Athlenda Mathe stated that Sotheni is alleged to be the hitman, while another suspect, Wiandre Pretorius, was the driver of the vehicle used in the drive-by shooting. Pretorius died by suicide.
The vehicle involved has been seized, but police are still searching for the firearm believed to be an AK-47 used in the murder.
Additional Charges and Court Proceedings
Sotheni also faces charges of attempted murder against Van der Merwe's wife and children. The case has been postponed to 25 March for a formal bail application.
