Supreme Court Decision on Temporary Protected Status
The US Supreme Court has ruled that the Trump administration is authorized to terminate Temporary Protected Status (TPS) for hundreds of thousands of Haitian and Syrian migrants who have been residing in the United States under this designation for several years.
The 6-3 decision overturned previous rulings by federal judges that had prevented the administration from ending TPS for approximately 350,000 individuals from Haiti and 6,100 from Syria.
This ruling, issued on Thursday, is expected to affect TPS holders from other nations as well.
Ruling on Asylum Applications at the US-Mexico Border
In a separate ruling, the Supreme Court determined that migrants arriving at the US-Mexico border are not entitled to apply for asylum until they physically enter the United States. This decision represents another legal victory for the Trump administration.
The court's 6-3 majority allowed President Donald Trump, a Republican, to reinstate a policy initially implemented in 2016 but rescinded in 2021 by the administration of President Joe Biden, a Democrat.
Federal law permits a migrant who "arrives" in the US to apply for asylum. The Trump administration argued that this excludes individuals stopped on the Mexican side of the border.
A lawyer for an immigrant advocacy group had argued that asylum seekers arrive in the US when they reach a port of entry.
