Family Confronts Suspect in Preliminary Hearing
On 6 May 2026, Charlie Kirk's parents, Robert W. Kirk and Kathryn Kirk, arrived at a Utah courthouse as the family of the US conservative activist faced the man accused of his murder. Prosecutors presented their case against Tyler Robinson, 23, during a preliminary hearing.
Kirk, a prominent Trump ally and founder of Turning Point USA, was fatally shot on 10 September 2025 while speaking at Utah Valley University in Orem, Utah. The shooting triggered a significant manhunt.
Authorities apprehended Robinson two days later. He has been charged with aggravated murder, felony discharge of a firearm, obstructing justice, and witness tampering. Robinson has not yet entered a plea, and Utah County prosecutors are pursuing the death penalty.

Family Statement and Court Attendance
Charlie Kirk, aged 31 and a father of two, was remembered by his family in a statement released prior to the hearing, which is expected to continue through Friday.
"Charlie was a beloved husband, son, brother, friend, and father," said Kirk's widow, Erika, his parents, Robert and Kathryn, and sister, Mary. "Every court proceeding serves as a painful reminder of his death and the loss that has irrevocably impacted our lives and the lives of his children."
Kirk's parents and widow arrived separately at the courthouse on Monday.
"We remain deeply grateful for the support, prayers, and kindness we have received," the family statement continued. "This outpouring has sustained us during the darkest days of our lives. Out of respect for the judicial process, we will not be commenting further at this time. We ask for continued privacy as we navigate this process and immense grief."
Defense Motions and Court Proceedings
Defense attorneys previously sought to exclude various pieces of evidence and unsuccessfully attempted to prohibit cameras in the courtroom during the preliminary hearing. They have also petitioned Judge Tony Graf to remove the death penalty option.
Robinson appeared in court wearing a light-colored suit, seated between his attorneys at the defense table.
Prosecutors indicated that four law enforcement witnesses were expected to testify during the day.
Details of the Shooting Incident
On 10 September, Kirk was speaking under a tent as part of his American Comeback tour of college campuses, during which he invited attendees to debate him. Around 12:20 pm, while addressing gun violence, a gunshot was fired; Kirk collapsed to the side.
Bagley, an officer stationed on a building above the event, identified the noise as coming from a rifle rather than a handgun.
He described a chaotic scene with people shouting and running. Law enforcement informed him that a shooter had been apprehended.
However, Bagley discovered suspicious evidence suggesting the arrested individual might not be the correct suspect.
He found a screwdriver and an impression in gravel on a roof consistent with a sniper’s position and reviewed security footage showing a person dropping down and fleeing the area.
Bagley described the impression left behind by the suspect:
"I could see the disturbance of gravel; to me, it looks like a sniper pad, a person that has been laying in a prone position, and you've got markings of elbows, knees and feet - where somebody was in the line of sight of where Charlie's tent was."
Defense attorney Kathryn Nestor raised several objections during the prosecution’s questioning of Bagley. She will have the opportunity to cross-examine him and other officers later in the hearing.
