Man Pleads Guilty to Culpable Homicide After Fatal Stabbing in Paisley

Incident Overview

A man has admitted to culpable homicide after fatally stabbing a 21-year-old during a violent confrontation following an attack on his home by a group armed with weapons including a machete and a hatchet.

Jaxon Millar, aged 19 at the time, stabbed Robert McNally, 21, after pursuing him down the street in the Foxbar area of Paisley in January of the previous year.

McNally and two other men, all masked and armed, repeatedly knocked on Millar's door before entering the property.

In an attempt to prevent their entry, Millar threw fireworks at the group from an upstairs window, as was detailed during proceedings at the High Court in Glasgow.

Court Proceedings and Sentencing

Millar is scheduled to be sentenced next month. However, Lord Mulholland, presiding judge, emphasized that imprisonment is unavoidable.

"This tit-for-tat violence only ends up in tragedy and where you are today.
You took the life of another person and it is a very serious matter."

Background and Motive

The court heard that although McNally and Millar were acquainted, they were not friends.

The conflict was reportedly sparked by McNally and his associates' anger over a woman known to Millar who had provided a police statement concerning domestic abuse allegations. This led to the detention of an individual, prompting the group to seek out Millar.

Earlier on the day of the incident, McNally's friends visited Millar's home, resulting in an argument.

Upon learning of this, McNally returned to Millar's residence with two companions.

After they knocked on the door, Millar again used fireworks to deter them from entering.

The men eventually forced their way into Millar's flat for a brief period of 30 to 60 seconds before leaving.

Escalation and Stabbing

Following their exit, one of the men began damaging Millar's car, joined shortly after by McNally.

Millar then left his home and pursued McNally.

Prosecutor Greg Farrell described the sequence of events:

"Millar caught up with him and stabbed him once on the back. Mr McNally fell to the ground.
The other man, who was armed, ran back and a brief altercation took place among the three men.
Mr McNally had got back to his feet.
During the altercation, Millar was struck on the side of the face with a hatchet."

Millar then retreated to his home as McNally and the other individual left the scene.

McNally collapsed, with the other man attempting to administer first aid and calling for assistance.

Aftermath and Investigation

The knife and hatchet involved were later recovered by authorities.

Emergency services responded promptly, but McNally succumbed to his injuries.

A post-mortem examination revealed that the knife had penetrated McNally's left lung, causing it to collapse, which was deemed sufficient to cause death.

Legal Charges and Defense

Initially charged with murder, Millar entered a guilty plea to the lesser charge of culpable homicide.

His defense lawyer, John Scullion, stated:

"The situation was Mr Millar was in his own home minding his own business.
Those who attended were there to intimidate and assault him.
These were people who were known for significant acts of violence and were there to inflict acts of violence on him.
These are the circumstances to which he reacted and he immediately tried to deter them with fireworks."

Millar remains in custody pending sentencing.

Tributes to the Deceased

Following McNally's death, tributes were offered by family and friends.

His girlfriend, Angel White, shared her sentiments:

"Robert darling. Our relationship wasn't perfect, you were the most hot headed, craziest boy I have ever met.
But there wasn't anything you wouldn't do for the people you cared about and that's what I loved about you.
You have been taken away from us all so sudden and far too early but I feel lucky to say I got to spend the last few months of your life by your side and I'm really going to miss you.
I'll always hold a place for you in my heart Robert, forever."
