Judge Approves Group Proceedings Against Covidien
A judge has authorized over 80 individuals to pursue a US-style class action compensation claim against the manufacturers of surgical mesh products.
Following a hearing at the Court of Session in Edinburgh, Lady Haldane granted permission for group proceedings to be initiated against Covidien LP.
All participants in the claim underwent hernia treatment involving mesh products produced by the company.
Opposition from Covidien
Covidien's legal team previously opposed the authorization of group proceedings. The firm's advocate, Astrid Smart KC, argued before the court that the claims were too varied to be managed collectively.
She highlighted differences in the types of mesh products used, the nature of the hernias treated, and the specific medical circumstances surrounding each case.
Judge Rejects Opposition Arguments
In a judgment published on Friday, Lady Haldane dismissed these arguments.
"On the question of commonality, the statutory test is whether the proposed proceedings raise issues that are the same as, or similar, or related to each other.
The issues are not identical, that much is true. The group members had a variety of mesh products implanted to treat various types of hernia.
The common factor is that all were manufactured by the respondent."
The judge emphasized that the legal test at this stage is not to examine each individual claim in detail but to determine if the cases involve issues that are the same, similar, or related.
Scope of the Case
The case involves 84 patients and will explore whether Covidien was negligent in relation to the mesh products.
The judgment does not establish whether Covidien was negligent or if any of its products were defective. It also does not determine whether any group member is entitled to damages.
These matters will be addressed at a later stage in the proceedings.
